US 6th Circuit Ct of Appeals grants en banc rehearing in Jason Getsy case

The US 6th Circuit Ct of Appeals yesterday granted a petition for an en banc rehearing in the case of Ohio death row inmate Jason Getsy, whose death sentence was vacated by a 3-judge panel of the court on August 2 after finding it "arbitrary," "disproportionate," and "inconsistent."  Yesterday's ruling vacates the August 2 order for a new sentencing hearing for Getsy, and also voids an order for an evidentiary hearing into judicial bias on the part of the trial judge.  (See earlier post here.)
